Dear Linda,
I understand your disappointment, but it IS illegal
to sell real estate without a license unless you’re
selling your own property. Someone complained to the
state about ME and (when they stopped laughing) they
said I would have to cease the selling and listing parts
of my career. (Actually, the office had been getting
some complaints about my driving so I was probably going
to have to stop anyway … I can’t see over
the dashboard!) The good news is that I am still allowed
to give real estate advice so keep your questions coming.
Is this a great country or what?
Your friend,
Howard
PS - By the way, North Carolina G.S. 47E requires owners
of real estate (single-family homes and buildings with
up to four dwelling units) to furnish purchasers a Residential
Property Disclosure Statement even if the owner is selling
the property without a Realtor®. This form must
be furnished in connection with the sale, exchange,
option and sale under a lease with option to purchase
(unless the tenant is already occupying or intends to
occupy the dwelling). A disclosure statement is not
required for some transactions, including the first
sale of a dwelling which has never been inhabited and
transactions of residential property made pursuant to
a lease with option to purchase where the lessee occupies
or intends to occupy the dwelling. For a complete list
of exemptions, see G.S. 47E-2.
This form is important because it is notice to the buyer
of the property’s condition, function and previous
problems. If you have any questions about this form
please contact an attorney or real estate broker.
